Why Pre-Legal Field Visits Often Secure Payment Faster Than Court Claims

A pre-legal field visit can put someone at a business debtor’s premises quickly, but not every court claim takes months to produce a result. Many undefended money claims can reach judgment sooner. Where a defended case goes to trial, however, the latest Ministry of Justice figures show a median 41.0 weeks for small claims and 55.9 weeks for fast, intermediate and multi-track claims in April to June 2026.
A field visit can therefore be a useful early recovery step where calls, emails and letters have failed.
What a pre-legal field visit actually involves
A collection agent attends the debtor’s trading address, checks whether the business appears to be operating and seeks to discuss the unpaid account. The aim may be full payment, a payment arrangement or better information about the debtor’s circumstances.
Taurus Collections’ pre-legal visit service says it can make up to two visits where required. A field agent is not a court enforcement agent and does not acquire bailiff powers simply by attending the premises.

Why court claims can take longer
The previous January-to-March 2026 Ministry of Justice release recorded a median 37.6 weeks from issue to trial for small claims. The latest April-to-June figure is 41.0 weeks. Fast, intermediate and multi-track cases reaching trial took a median 55.9 weeks.
These figures apply to cases reaching trial, not every claim. An undefended case may result in default judgment much sooner. Even after judgment, further action can be required if the debtor does not pay, as our guide to CCJ enforcement options after judgment explains.
| Factor | Pre-legal field visit | County court claim |
|---|---|---|
| Initial action | Often arranged quickly | Can be issued promptly; defended cases take longer |
| Cost | Service fee depends on location | Court fee and possible enforcement costs |
| Best suited to | Debtors ignoring ordinary contact | Disputes or cases needing an enforceable judgment |
| Relationship impact | Direct but potentially less formal | More adversarial once proceedings begin |
| Possible outcome | Payment, plan or useful information | Settlement, judgment or enforcement |
Why face-to-face contact can help
A visit can make continued non-engagement harder and establish whether the business is still trading at the address. It does not guarantee payment and must not involve threats, harassment or any false suggestion that the visitor has official enforcement powers.
Section 40 of the Administration of Justice Act 1970 prohibits certain harassment and false representations when pursuing contractual debts. That matters when comparing debt collectors vs lawyers or considering mediation vs litigation for unpaid invoices.
When a field visit is not enough
If liability is genuinely disputed, a visit cannot determine the legal merits. Start with the disputed invoices flowchart. Where the debtor is insolvent, read recovering debt from insolvent customers and the when to escalate to third party collections checklist.
For an overseas debtor, international debt collection may be more appropriate. A credit check can help assess the debtor before spending more on recovery.
This approach may also be useful in construction debt collection where businesses operate from identifiable offices or sites. An outsourced credit control process can help identify problem accounts earlier.
Frequently asked questions
Are pre-legal field visits legal?
Yes, provided they are conducted lawfully. A field collector has no court enforcement powers merely because they attend in person and must not misrepresent their authority.
What happens if the debtor refuses to engage?
The visitor can record the outcome and relevant observations, but refusal to speak does not prove the debt or automatically strengthen a later claim.
Do field visits work for large commercial debts?
They can be used for debts of different sizes, but suitability depends on whether the debt is disputed, the debtor’s financial position and the likely value of further recovery action.
